A GRAVE PLOT – Vaeschanan

There was a money lender in Posen who ignored the Torah prohibition of usury, and lent money with interest to other Jews.  When this man passed away, the heads of the kehilla refused to allow him to be buried in the town’s cemetery unless his family paid an exorbitant sum.  The family reported this to the city council, and the council ordered R’ Akiva Eiger, the Rav of the city, to come and explain why the deceased and his relatives were being treated in this way. R’ Akiva Eiger explained that under normal circumstances, the families of the deceased are asked to pay a reasonable sum for a burial plot.  This is because the Jews believe in the revival of the dead, and therefore the cemetery plots are only being leased on a temporary basis.  However, the Torah says that one who lends money with usury will not merit being revived from the dead, and therefore the plot of this man was not being leased but was sold on a permanent basis and was more expensive.  The explanation of R’ Akiva Eiger was accepted and the family was forced the pay the sum that was charged.

Good Shabbos,

Rabbi Moshe Cohen

Halacha of the Week

Shulchan Aruch rules that in “cold lands” one may ask a gentile to light a fire if the house is exceedingly cold (and, if there are children, even if it is “merely cold”). The basis for this ruling is: ”everyone has the status of a choleh (or potential choleh) regarding the cold.”

Rav Moshe Feinstein applies this rule to a situation where an air conditioner was left on for Shabbos and the weather turned very cold.  He permits asking a non-Jew to turn off the air conditioner.
Minchas Yitzchok rules that it is permissible to ask a non-Jew to turn on an air conditioner on an exceedingly hot day. He considers this parallel to that mentioned by the Shulchan Aruch: ”that everyone is considered a choleh (or potential choleh) in a situation of extreme heat.” He bases his ruling on Rav Shlomo Zalman Auerbach’s opinion that completing a circuit is not a Torah prohibition if no filament is heated until it glows, and asking a gentile to turn on the air conditioner since only a rabbinic prohibition is involved, and the Shulchan Aruch rules that one may ask a non-Jew to perform an act that is rabbinically prohibited in case of considerable suffering.

Rav Mendel Silber adds that one may certainly be lenient if the reason for turning on the air conditioner is L’tzorech mitzvah .
